These terms apply to orders placed through cvsbarkmulch.com with CV’s Bark Mulch, 494 Franklin Street, Framingham, MA 01702, (508) 872-7630. By placing an order you agree to them. If anything here is unclear, please call us before you order — we would rather talk it through than have a delivery go wrong.

Ordering

• All materials are sold by the cubic yard. Prices shown on the site are per cubic yard in US dollars, and the price shown at checkout is the price for that order.
• There is a 3 cubic yard minimum per delivery, in any mix of mulch and loam.
• Prices and availability can change at any time. We make our own mulch, so supply of a given product is seasonal.
• Your order is an offer to buy. We may decline or cancel an order — for example if a material has run out, the delivery address cannot be reached by truck, or a price was listed in error — and if we do, we refund you in full.

Delivery

• As of the date above we deliver to Ashland, Concord, Dover, Framingham, Holliston, Hopkinton, Lincoln, Marlborough, Natick, Needham, Newton, Sherborn, Southborough, Sudbury, Wayland, Wellesley, Westborough and Weston. Checkout is the authoritative list: if your ZIP code is not in our delivery area, checkout will not offer a delivery option. Call us anyway — we can sometimes go further for a worthwhile order.
• Delivery is charged per truckload and is calculated at checkout from your town and the size of your order. One truck carries up to 18 cubic yards of mulch, or up to 10 cubic yards of loam because it is heavier. Orders larger than one truckload are charged for each truck, and a mixed load is billed at a blended rate.
• We arrange timing with you after you order. We can often deliver the same day, but we cannot guarantee a particular date or time. Weather, equipment and road conditions can delay a delivery.
• You do not need to be home, as long as we can reach the drop-off spot.

Drop-off location

Before we deliver, mark the spot where you want the material with a trash can, bin, cone or something similar on the ground, so the driver can see it from the road. At checkout we ask you to confirm you have done this.

• The spot must be on your property, reachable by a loaded dump truck, and clear of obstructions overhead — power lines and low tree branches especially — as well as cars, fences and gates.
• If nothing is marked, or the spot cannot be reached safely, the driver will either leave the material in a reasonable place near the driveway or contact you. If we have to come back another day, a second delivery charge may apply.
• Dump trucks are heavy. We take care on your property, but we cannot be responsible for damage to lawns, driveways, walkways, septic systems, irrigation or anything else below ground that we were not told about. Tell us in the order notes or by phone if there is somewhere we should not drive.

Payment

• We accept credit and debit cards through our payment processor, CardPointe. Card details go straight to the processor — we never see or store your full card number. Your card is charged when you place the order.
• You can also pay by check, made out to CV’s Bark Mulch and left at the drop-off spot.
• Massachusetts sales tax of 6.25% is added to materials. Delivery is not taxed.

Changes and cancellations

Call us at (508) 872-7630 as soon as you can. If the truck has not been loaded yet, we can change or cancel your order and refund you in full. Once a load has left the yard we may not be able to, because bulk material cannot be put back once it is loaded. See our Refund and Returns Policy for what happens after a delivery.

About our materials

Bark mulch and loam are natural products. Color and texture vary from batch to batch and change with sunlight, weather and moisture, so the material you receive will not match a photograph exactly. Quantities are measured by loader bucket in the yard and are accurate to normal commercial tolerances for bulk material.

Your account

If you create an account, keep your password to yourself and your contact details current. Tell us right away if you think someone else has used your account. We handle the information you give us as described in our Privacy Policy.

Limits

Except where the law says otherwise, our responsibility for any order is limited to what you paid for that order. Nothing in these terms takes away rights you have under Massachusetts consumer protection law.

General

These terms are governed by the laws of the Commonwealth of Massachusetts. If we change them, the updated version will be posted on this page with a new date, and the version in effect when you ordered is the one that applies to your order.
